Terms of use

1. Scope and acceptance

These terms govern your use of the ProofWipe website (proofwipe.com and proofwipe.ca), operated as a sole proprietorship based in British Columbia, Canada (“we”, “us”, “our”). By using the site you accept these terms. Use of the ProofWipe software is governed separately by any end-user licence terms that accompany or are presented with the software; where the two conflict regarding the software, those licence terms prevail.

2. Downloads and integrity

ProofWipe is distributed exclusively through the official GitHub Releases page linked from this site. Verify the published SHA-256 checksum before running any download. Copies obtained from any other source are not distributed by us, may have been altered, and are used entirely at your own risk.

3. Responsible use of the software

ProofWipe permanently destroys data by design. You are solely responsible for: (a) ensuring you own, or are authorized by the owner to sanitize, any device you target; (b) selecting a sanitization category appropriate to your data sensitivity, policies, and legal obligations; and (c) verifying you have retained any data you need before sanitizing. Sanitized data cannot be recovered: that is the product's purpose.

4. Standards and certification

ProofWipe implements published sanitization standards. It is not a third-party-certified product. Statements on this site describing standards alignment are informational and do not constitute certification, accreditation, or a guarantee of regulatory compliance for your organization; responsibility for your compliance program remains yours.

5. No warranty

The website and its content are provided “as is” and “as available” without warranties or conditions of any kind, whether express, implied, or statutory, including fitness for a particular purpose, merchantability, and non-infringement, to the maximum extent permitted by applicable law. Warranties applicable to the software itself, if any, are stated exclusively in its licence terms.

6. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or exemplary damages arising from use of this website (including loss of data, loss of profits, or business interruption), even if advised of the possibility. Our total aggregate liability arising from or related to the website or these terms will not exceed one hundred Canadian dollars (CAD $100).

Nothing in these terms excludes or limits liability, or any right or remedy, that cannot be excluded or limited under applicable law, including under applicable consumer-protection legislation. Where such law applies, the exclusions and limits above apply only to the extent that law permits.

7. Intellectual property

The ProofWipe name, logo, and all site content are the property of Ryan Werk or its licensors. You may not use the ProofWipe name or logo without prior written permission, except for factual reference to the product.

8. Third-party links and services

The site links to third-party services (GitHub for downloads, cyber.gc.ca for standards documents) and uses Formspree for contact delivery. Those services are governed by their own terms and privacy policies, which we do not control.

9. Governing law

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. The courts located in British Columbia have exclusive jurisdiction over disputes arising from these terms or the website, subject to any non-waivable right you may have to bring proceedings in your own jurisdiction of residence.

10. Changes

We may update these terms from time to time; material changes will be posted on this page with an updated effective date. Continued use of the site after changes take effect constitutes acceptance.
